Terms & Conditions of entry

1. Information on how to enter and prize details form part of these terms & conditions (Terms of entry). The Terms must be read in conjunction with the Schedule. The Schedule defines the terminology used in these Terms of entry. Where there is any inconsistency between these Terms and the Schedule, the Schedule prevails. Participation in this promotion is deemed acceptance of these Terms of entry.
2. Entry is open only to Eligible entrants who satisfy the Method of entry.
3. The promotion will be conducted during the Promotional Period.
4. The Prizes are specified in the Details of prizes section of the Schedule.
5. The total prize pool is specified in the Total prize value section of the Schedule. Eligible Entrants cannot win more than one prize.
6. Any prize is valued in Australian dollars unless expressly stated to the contrary.
7. All voucher/gift card prizes are valid until the expiry date stated on the voucher/gift card or by the provider of the voucher/gift card. Any ancillary costs associated with redeeming the voucher/gift card are not included. Any unused balance of the voucher/gift card will not be awarded as cash. Redemption of any voucher/gift card is subject to any terms and conditions of the issuer including those specified on the voucher/gift card. 
8. A replacement prize will not be issued in the event a winner does not receive their prize due to circumstances outside the reasonable control of the Promoter, for example, if a winner fails to provide an up-to-date email address or postal address for the delivery of a prize.  Any issues with using a prize should be directed to the provider of the prize.
9. Neither the Promoter nor any prize provider is liable for any prize that has been stolen, forged, lost, damaged or tampered with in any way.
10. Subject to the Unclaimed prize draw, if for any reason a winner does not take / redeem their prize by the time stipulated by the Promoter, then a prize will be forfeited.
11. If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute a prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
12. Eligible Entrants must follow the Method of entry during the Promotional Period to enter the promotion. Failure to do so will result in an invalid entry. The Promoter will not advise an entrant if their entry is deemed invalid. Eligible Entrants cannot win more than one (1) prize.
13. The time of entry will be deemed to be the time the entry is received by the Promoter.
14. If there is a dispute as to the identity of a winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the winner.
15. The Promoter accepts no responsibility for any late, lost, delayed, incomplete, incorrectly submitted, corrupted, illegible or misdirected entries, claims or correspondence whether due to omission, error, alteration, tampering, deletion, theft, destruction, disruption to any communication network or medium, or otherwise including those entries not received by the Promoter for any reason. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. The Promoter's decision is final and no correspondence will be entered into.
16. Each prize will be awarded in order as per Details of prizes to the Eligible Entrants drawn randomly via selection from the computer database containing all entries submitted from Eligible Entrants in accordance with the Prize draw details. The Promoter will draw additional reserve entries (and record them in order) in the event of an invalid entry of an ineligible entrant, or if the entrant is ineligible to accept the prize, the prize will be awarded to the first reserve entry drawn.
17. Winners will be notified in accordance with the Notification of winners and Notification of unclaimed prize winners (if applicable) sections of the Schedule. The notification will include details about how the prizes can be claimed. This may include collecting the prize at the winner’s nearest Beyond Bank branch.
18. The Promoter takes no responsibility where it is unable to contact prize winners who have not provided correct or complete contact details. If an Eligible Entrant’s contact details change during the Promotional Period, it is the Eligible Entrant's responsibility to notify the Promoter. A request to modify any entry information should be directed to Beyond Bank at contactus@beyondbank.com.au or by calling 13 25 85.
19. It is a condition of accepting a prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. Each must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
20. Claimants consent to the Promoter using their name, likeness, image and/or voice in the event they are a successful claimant (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
21. To the greatest extent permitted by law, the Promoter excludes all warranties, representations or guarantees (Warranties) regarding the promotion and any prizes, including any Warranties which may have been made in the course of advertising or promoting the promotion. The conduct of the promotion or the supply of prizes may involve third parties, and the Promoter makes no Warranties and disclaims all liability in connection with any such third parties, their acts or omissions. By entering the promotion, an Eligible Entrant releases and indemnifies the Promoter and its related bodies corporate (including the officers, employees and agents of each) from and against all actions, penalties, liabilities, claims or demands the Eligible Entrant may have against the Promoter or that the Promoter may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an Eligible Entrant entering or participating in the promotion or winning or failing to win a prize, or using or permitting any other person to use the prize, except for any liability which cannot be excluded by law or which would cause any part of this clause to be void or unenforceable.
22. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of / taking of the prize.
23. If despite the foregoing clause, the Promoter incurs a liability to an Eligible Entrant under any law which implies a Warranty into these Terms of entry which cannot legally be excluded, the Promoter’s liability in respect of the promotion is limited, in the Promoter’s discretion, to either resupplying such goods or services as form part of the promotion, or paying the cost of resupplying those goods or services.
24. The Promoter and its associated agencies and companies will not be liable for any damage in transit to or delay in transit of prizes.
25. The Promoter may in its absolute discretion not accept a particular entry, may disqualify an entry, or cancel the entire promotion at any time without giving reasons and without liability to any entrants, subject to any written directions from a regulatory authority. Without limiting this, the Promoter reserves the right to verify the validity of entries, prize claims and entrants and to disqualify any entrant who submits an entry or prize claim that is misleading or not in accordance with these Terms of entry or who manipulates or tampers with the entry process. In the event that a winner breaches these Terms of entry, the winner will forfeit a prize in whole and no substitute will be offered. Verification is at the discretion of the Promoter, whose decision is final. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
26. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, subject to any written directions from a regulatory authority. Where a prize is unavailable for any reason, the Promoter may substitute a prize for another item of equal or higher value subject to any written directions from a regulatory authority. The Promoter accepts no responsibility for any variation in prize value (including between advertising of the promotion and receipt of the prize).
27. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability (or that of a third party involved with the promotion) to proceed with the promotion on the dates and in the manner described in these Terms of entry, including but not limited to vandalism, natural disasters, pandemic, acts of God, civil unrest, strike, war, act of terrorism, the Promoter’s obligations in respect of the promotion will be suspended for the duration of the event and, in addition, the Promoter may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions, subject to approval of the relevant authorities.

29. Facebook, YouTube or Instagram may be used to advertise or promote the promotion. By entering the promotion, entrants agree that the promotion is no way sponsored, endorsed or administered by, or associated with Facebook, YouTube or Instagram; and to release Facebook, YouTube, or Instagram from all liability in relation to this promotion. Any questions, comments or complaints regarding the promotion should be directed to the Promoter and not Facebook, YouTube, or Instagram.
30. Beyond Bank has entered into contractual arrangements with Convera Australia Pty Ltd (ACN 150 129 749; AFSL 404092) (“Convera”), whereby Convera assists in fulfilling certain foreign exchange and payment services offered by Beyond Bank to its customers (including telegraphic transfers). You remain a customer of Beyond Bank at all times. Neither Beyond Bank nor Convera give you any advice (general, personal or otherwise). Relations between you and Beyond Bank shall be governed by the applicable Fees & Charges and Terms & Conditions provided to you before you transact. No representations, warranties or conditions of any kind, express or implied, are made in this communication. The above information has been prepared without taking into account your personal needs, financial circumstances or objectives and you should consider if it is appropriate for you.

1. The Switch to eStatements Competition is conducted by Beyond Bank Australia Ltd (ABN 15 087 651 143, AFSL / Australian Credit Licence 237856), 100 Waymouth Street, Adelaide, SA 5000.
2. Customers who register for the eStatement service within the promotion period will be automatically entered into the draw.
3. Employees, contractors, officers and directors of the Promoter, or their immediate family members, are ineligible to enter. Additionally, existing customers that were already registered for eStatements prior to the Competition start date are also ineligible to enter.
4. The Competition commences at 9:00am on Wednesday 15 November 2023 and closes at 11:59pm on Thursday 14 December 2023. All times recorded throughout these Terms and Conditions are in Australian Central Daylight Time.    
5. The Competition consists of four individual prizes valued at $500 each, to be credited to each winners’ Beyond Bank Account.  The total value of the prizes is $2,000.
6. The prizes cannot be transferred, exchanged or redeemed for cash.
7. The winners shall be drawn at random at 9:00am on Friday, 15 December 2023 at Beyond Bank, 100 Waymouth St, Adelaide SA 5000.
8. The winners will be notified by phone or email within 2 business days of the draw. Names of winners will be published on our website within 7 days of the prize draw.
9. The prizes are to be credited to the winners’ Beyond Bank accounts within 4 business days.
10. The Promoter will use entrants’ personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and, as required, to Australian regulatory authorities.  Entry is conditional on providing this information.  Unless otherwise advised, the Promoter may also use the information for promotional, marketing and publicity purposes including sending electronic messages.  Beyond Bank’s Privacy Policy can be found at www.beyondbank.com.au/privacy.
11. Subject to complying with all relevant State and Territory legislation, the Promoter reserves the right to amend, cancel or suspend this Competition if an event beyond the control of the Promoter corrupts or affects the administration security, fairness, integrity or proper conduct of the Competition.

1. The Win a Signed 2023 Melbourne Football Club Guernsey Competition is conducted by Beyond Bank Australia Ltd (ABN 15 087 651 143, AFSL / Australian Credit Licence 237856), 100 Waymouth Street, Adelaide, SA 5000.
2. Entry is open to participants aged 18 years and over who are existing customers of Beyond Bank and complete the survey received from the Beyond Bank eDM.  
3. Employees, contractors, officers and directors of the Promoter, or their immediate family members, are ineligible to enter. 
4. A maximum of one entry will be accepted per participant.
5. The Competition commences at 5:00pm on Monday 20 November 2023 and closes at 5:00pm on Thursday the 30 November 2023.  All times recorded throughout these Terms and Conditions are in Australian Central Daylight Time (ACDT)
6. The Competition consists of one Signed MFC Guernsey valued at $250. The total value of the prizes is $250.
7. The prize cannot be transferred, exchanged or redeemed for cash.
8. The winner shall be drawn at random at 10:00am on Monday 11 December 2023 at Beyond Bank, Level 11, 100 Waymouth Street, Adelaide SA 5000.
9. The winner will be notified via phone/email by close of business on Monday 11 December 2023.
10. The prize is to be express posted to the winner.
11. If the prize remains unclaimed by 5:00pm, Friday 5 January 2024, it will be redrawn.  The redraw will be conducted on Monday 8 January 2024 at the same time and place as the initial draw.  
12. If any prize is not available due to any reason beyond the Promoter’s control, the Promoter shall be at liberty in its discretion to substitute the prize with another similar prize of equivalent monetary value.
13. The Promoter will use entrants’ personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and, as required, to Australian regulatory authorities.  Entry is conditional on providing this information.  Unless otherwise advised, the Promoter may also use the information for promotional, marketing and publicity purposes including sending electronic messages.  Beyond Bank’s Privacy Policy can be found at www.beyondbank.com.au/privacy.
